withfocus │ Terms of Service

These Terms of Service ("Terms") set forth the conditions for using the smartphone application "withfocus" ("App") provided by the operator of the App ("Operator"). Users must use the App after agreeing to these Terms.

Article 1 (Applicability)

These Terms apply to all relationships between the User and the Operator regarding use of the App.

Article 2 (App Features)

The App provides focus time measurement, statistics, companion progress display, widget integration, Room Creator using generated images, and related features. The Operator may add, change, suspend, or terminate App features as necessary.

Article 3 (In-App Purchases)

  1. Certain features, characters, tickets, and other items may be offered for a fee.
  2. Paid items can be purchased through Apple Inc.'s in-app purchase system. Billing is charged to the User's Apple ID.
  3. Regardless of the reason, the Operator does not refund fees already paid. However, full or partial refunds may be made where Apple App Store terms and procedures apply, or where the Operator determines that special circumstances warrant a refund.

Article 4 (Room Creator)

  1. Room Creator generates images using an external AI service based on the images and text you enter.
  2. Each generation consumes the designated number of tickets. If generation fails, tickets may be returned according to processing determined by the Operator.
  3. Generated results are created by AI, so the Operator does not guarantee that the content or quality will match your intent. Generation may take time, and continuous availability is not guaranteed.
  4. You are solely responsible for your input and generated content, and the Operator is not liable for disputes with third parties, rights infringements, damages, or similar matters.

Article 5 (User Content)

  1. The User represents that they have the necessary rights to photos, text, and other information entered or uploaded to the App.
  2. The User must not enter or upload content that infringes third-party copyrights, trademarks, portrait rights, privacy, or other rights.
  3. The Operator may reject, delete, or restrict user content or generated results as necessary for legal compliance, abuse prevention, rights protection, and service operation.

Article 6 (Prohibited Acts)

Users must not engage in the following acts when using the App:

  • Acts that violate laws, regulations, or public order and morals.
  • Entering or uploading content intended for hate speech, extreme violence, explicit sexual content, child exploitation, defamation, or similar purposes.
  • Entering or uploading content that infringes third-party intellectual property rights, such as copyrights or trademarks, or is intended for unauthorized copying.
  • Attempting unauthorized access, analysis, modification, excessive requests, or fraudulent acquisition of tickets or purchase information related to the App, server, or external services.
  • Other acts deemed inappropriate by the Operator.

Article 7 (Intellectual Property Rights)

Rights to text, images, characters, programs, designs, and all other content included in the App belong to the Operator or legitimate rights holders. Users may not copy, reprint, redistribute, or modify such content beyond the scope permitted by law without permission.

Article 8 (Disclaimer)

While the Operator strives to provide stable service, it does not make any warranties whatsoever regarding the continuity, safety, accuracy, fitness for a particular purpose, or results obtained through the use of this App. The Operator shall not be liable for any damages (including indirect, special, consequential damages, or lost profits) incurred by Users through the use of this App, regardless of the cause. This includes, but is not limited to, the following:

  • Damages related to the content or quality of images generated by the external AI service used in Room Creator
  • Damages related to infringement of copyrights or other intellectual property rights arising from the use of external AI services
  • Effects caused by suspension, interruption, or errors of external AI services or other third-party services
  • Data loss due to device failure, device migration, or App deletion
  • Data loss or corruption caused by factors outside the App's control

These risks are borne by the User, and the User agrees that the Operator shall not be liable for any issues that arise.

Article 9 (Changes to Terms)

The Operator may update these Terms as necessary in response to changes in laws or services.

  • Material changes: For revisions that may significantly affect or disadvantage users, we will provide advance notice in the App or on the official website and obtain any required consent.
  • Minor changes: Changes take effect automatically once posted in the App or on the website.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. In the event of a dispute regarding the App, the court having jurisdiction over the Operator's location shall be the exclusive agreed court of first instance.
